Moved Larsen/ Seconded Linton That the memorandum from Brookfields lawyers dated 11 April 2011 and entitled Proposed Plan Budget and Decision Making, which was not subject to public exclusion under the resolution, be made available to the public including on the Council's website as part of the Council business papers.
Public excluded resolutions are strictly controlled and must be provided in the form set out in Schedule 2A of the Local Government Official Information and Meetings Act 1987 as further illustrated by Appendix B in the Model Standing Orders. The resolution passed at the last meeting did not list the Brookfields’ opinion as a public excluded document and it is therefore part of the public record of Council's proceedings and must be placed so that the public can have access to the document. The presumption is that all documents that form part of Council's deliberations will be part of the public record unless the document, having been explicitly referred to in a Schedule 2A resolution, becomes part of the public excluded deliberations. I note that the current form of resolution that is being presented to Council does not accord with the form as required by Appendix B of the Standing Orders.
