Motion

Moved Larsen That the Chief Executive provide the Council with an itemised report detailing the projected ongoing costs of the district plan review process. The report should include estimates of the costs of appeals based on examples of costs of other similar notifications and include timeframe and estimated costs for complying with the Regional Policy Statement and New Zealand Coastal Policy Statement and how these are to be funded, by 20 July 2011; and That the Chief Executive provide a standard section in the Chief Executive’s report summarising the costs of the review to date and an updated projection of the ongoing projected costs and how these are to be funded.

My analysis -

3.11.1 First repeat where notice of motion rejected states –

“When a motion which is the subject of a notice of motion has been considered and rejected by the local authority, no similar notice of motion which, in the opinion of the chairperson, is substantially the same in purport and effect may be accepted within the next 6 months unless signed by not less than one third of all members, including vacancies.” (underlining added)

I have checked the minutes of the 27 April 2011 meeting and can not find a record of any notices of motion.

Therefore it appears that the refusal to accept this notice of motion is unlawful.
